You retain ownership of your original content submitted through our Services but grant PLNY a non-exclusive, royalty-free license to use it in connection with providing the Services.

6. Privacy and Data Practices

Your use of the Services is subject to our [Privacy Notice, which outlines how we collect, use, retain, share, and protect personal data. PLNY is committed to safeguarding your information and adheres to internal policies governing data classification, retention schedules, breach response, and access request procedures.

PLNY retains personal data only as long as necessary to fulfill the purposes for which it was collected or as required by applicable law. Specific legal retention periods apply to certain data types (e.g., educational records under FERPA, children’s information under COPPA, and information subject to NY Ed. Law § 2-d). General business data is typically retained for three to seven years, depending on operational and legal considerations.

We use third-party advertising platforms (e.g., Meta and Google) to create lookalike audiences, perform remarketing, and target users based on interests and online behavior. We do not sell user data. Custom audience lists are securely uploaded, used only for limited campaigns, and deleted after use. All practices comply with our Privacy Notice and Cookie Consent Notice.

We reserve the right to delete or deactivate user data, including account information and service-related activity, following the expiration of applicable retention periods or after extended inactivity.

Where feasible and lawful, we may anonymize data instead of deleting it. Anonymization involves removing all personally identifiable information so that the data can no longer be linked to an individual. Once anonymized, data may be retained beyond standard retention periods for analytical, operational, or reporting purposes.

All data retention, review, anonymization, and deletion activities are conducted in accordance with PLNY’s internal Data Retention and Deletion Procedure and applicable laws.

7. Account Suspension and Termination

PLNY reserves the right to suspend or terminate your access to the Services at our sole discretion, with or without notice, for any violation of these Terms.

We may also delete user accounts and associated data after extended periods of inactivity, as defined in our internal data retention and deletion policy.

8. Dispute Resolution and Arbitration

You agree to resolve any disputes arising out of or relating to these Terms through binding arbitration in New York, New York, under the rules of the American Arbitration Association. You waive any right to participate in a class action or jury trial.

This agreement to arbitrate survives termination of these Terms.

9. Modification of Terms

PLNY may update these Terms from time to time. Material changes will be posted on our website with the effective date. Continued use of the Services after such updates constitutes acceptance of the revised Terms
